  • Limiting AI decision-making in Illinois. House Bill 1806 prohibits licensed behavioral healthcare providers from letting AI make independent decisions.

  • Regulating disclosure in Texas. House Bill 149 requires providers to disclose AI use for diagnosis or treatment planning.

The U.S. Food and Drug Administration (FDA) has also weighed in. In January 2026, the FDA issued updated guidance clarifying which clinical decision support software is exempt from medical device oversight, and the bar is specific. To remain exempt, software must meet all four of the following criteria:

  1. It must not acquire, process, or analyze medical images or diagnostic signals. This includes CT scans, MRIs, X-rays, and signals from diagnostic devices or monitoring systems.

  2. It must display or analyze medical information. This includes patient-specific data, clinical study results, and other information used in the course of care.

  3. It must support — not replace — clinical recommendations. The software must help providers think through prevention, diagnosis, or treatment, without issuing directives or making autonomous decisions.

  4. It must enable independent review. Providers must be able to examine the basis for any recommendation the software makes — and must not be expected to rely on it as the sole input for clinical decisions.

If a software function fails any one of these criteria, it becomes subject to FDA oversight as a medical device. In short: If the clinician can’t see how the AI reached its conclusion, the AI is no longer a tool — it’s a medical device.
